TERMS OF SERVICE

• Right to Refuse Service: We reserve the right to refuse service to anyone for any reason at any time.

• Age Restriction: By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

• Accuracy of Information: We are not responsible if information made available on this site is not accurate, complete or current. Any reliance on the material on this site is at your own risk.

• Unauthorised Use: You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Services, use of the Services, or access to the Services or any contact on the website through which the Services are provided, without express written permission by us.

• Data Transmission: You understand that your content (not including credit card information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

• Headings: The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

• Gemstone and Jewellery Appearance: We make every effort to display the colours, features and images of our products as accurately as possible. However, the true colour and appearance may vary slightly due to your device's screen settings. Furthermore, as natural gemstones are unique, minor variations in colour, saturation and inclusion patterns are expected and are characteristic of their genuine nature.

• Measurements: All product measurements, including carat weight, dimensions and ring sizes, are provided as approximate values.

• Authenticity: All natural gemstones and precious metals are guaranteed for authenticity as described in the product listing or custom design documentation.

• Valuations: We may provide a complimentary or chargeable independent valuation on certain pieces. The valuation reflects an estimated retail replacement value and is provided by a qualified, independent third party.

• Order Confirmation: Your placement of an order does not automatically constitute our acceptance of that order. We reserve the right to refuse any order you place with us. We may, at our sole discretion, limit or cancel quantities purchased per person, per household or per order.

• Payment: We accept payment by Visa, Mastercard, American Express, PayPal, Bank Transfer, Apple Pay and Klarna. Full payment is required before an order for a finished piece is dispatched or before work on a custom commission commences.

  Custom/Bespoke Orders

  • Deposit: All custom design and bespoke orders require a non-refundable design fee and/or a minimum deposit of 50% of the total estimated price to begin work.

  • Design Approval: Commencement of work is contingent upon your final approval of the design renders, sketches or wax models. Once approved, the design cannot be changed and the deposit is non-refundable.

• Shipping Estimates: All shipping and delivery timeframes provided are estimates only. We will not be liable for any loss or damage suffered as a result of any delay in delivery once the item has been dispatched.

• Risk of Loss: The risk of loss or damage to the product passes to you upon delivery to the address you specify, or upon collection from our premises or an agreed collection point. All shipments will be fully insured by us until this point.

• International Orders: You are responsible for any duties, taxes or customs clearance fees levied by your country of residence or the final shipping destination.

Your rights under the Australian Consumer Law (ACL) cannot be excluded or limited by these Terms. The information below is in addition to, and does not replace, your rights under the ACL.

• Change of Mind:

  • We offer a 14-day return period for a change of mind on standard, in-stock jewellery items, provided the item is returned in its original, unused and unworn condition, complete with all original packaging, documentation (including certificates) and proof of purchase.

  • The cost of return shipping is your responsibility.

  • EXCLUSION: This Change of Mind policy does NOT apply to custom-made, bespoke pieces, any earrings (due to hygiene requirements), specially sourced gemstone items or items that have been resized or engraved at your request. These sales are considered final.

• Consumer Guarantees (ACL):

  • Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

  • Acceptable quality is assessed considering the price, product description and any representations made by us.

  • Normal wear and tear, misuse or accidental damage is not covered by the ACL.

• Faulty Items: If you believe a product is faulty or does not meet an ACL guarantee, you must notify us immediately. We will arrange for the item to be inspected. If deemed a genuine manufacturing fault, we will offer a repair, replacement or refund in accordance with the ACL.

• Manufacturing Warranty: We provide a 12-month limited warranty against manufacturing defects on all finished jewellery pieces. This warranty is in addition to your rights under the ACL.

• Exclusions: The warranty and ACL guarantees do not cover:

  • Damage resulting from misuse, accidental damage or improper storage.

  • Damage caused by a failure to obtain recommended maintenance (e.g., ring claw checks).

  • Deterioration due to normal wear and tear (e.g., surface scratches, light dents).

  • Damage or loss of stones resulting from impact or poor care.

  • Jewellery that has been repaired, resized or modified by any jeweller other than Ruhuna Gemstones.

• Care and Maintenance: You agree to follow all reasonable care instructions provided by us (e.g., avoiding chemical exposure, high impact). Failure to do so may void your manufacturing warranty.

• Copyright: All content on this website, including designs, images (with the exception of stock images in ’Our Story’), text, logos and digital materials, is the property of Ruhuna Gemstones and is protected by copyright laws. You may not reproduce, duplicate, copy, sell, resell or exploit any portion of the content without our express written permission.

• Custom Designs: The intellectual property rights in the final physical piece belong to you upon final payment. However, Ruhuna Gemstones retains the copyright and commercial rights to all design work, sketches, CAD files and photographs of the piece for promotional and archival purposes.

To the maximum extent permitted by law, Ruhuna Gemstones will not be liable for any special, indirect, or consequential loss or damage, or any loss of profit or opportunity arising out of or in connection with the Services, except where such loss is a reasonably foreseeable result of our failure to meet an applicable Consumer Guarantee under the ACL.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Victorian Government and the Commonwealth of Australia.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
